First-degree manslaughter is a less severe charge than murder but can still result in significant consequences.
The maximum penalty for first-degree manslaughter is life imprisonment.
The state must prove that
- a person’s life was taken in a non-justifiable or inexcusable way in the heat of passion,
- the death occurred while the deceased was resisting an attempt by the defendant to commit a crime, or
- the death occurred while the defendant was trying to carry out a misdemeanour.
Second-degree manslaughter is the least severe homicide charge and can result in up to four years in prison.
It is defined as all other killings that are non-justifiable or excusable yet do not result in any of the criminal charges found above.
